When is an employer notice complete enough to decide?

Learn how a German works council can assess whether an employer notice contains the information needed for a participation procedure.

An employer email can look detailed and still omit a fact the council needs. Conversely, a missing attachment does not automatically prevent every response period from beginning. The useful question is not “Did we receive everything?” but “Can the council exercise this particular participation right on the information supplied?”

Start with the proposed measure

Write one factual sentence describing what the employer intends to do. For a transfer, that may include the employee’s future workplace, duties, reporting line, intended duration and effective date. This prevents the file name or employer label from defining the analysis.

An information request is stronger when it shows why the fact matters. If grading is in issue, identify the job characteristics or comparison information needed to assess the proposed classification. If a working-time rule is planned, ask for the actual start, end, break or roster arrangements rather than “all operational information.”

Keep receipt evidence

Preserve the original transmission and record when the council body received it. Do not rely on a member’s later forwarding time. If the council believes the statutory period has not started, record both the missing information and the reason it is necessary.

Avoid deciding the merits too early

Members may already have a view on the employer’s plan. First determine whether the file enables the council to deliberate and whether a formal information request is needed. That separation reduces the risk of mixing procedural completeness with the ultimate position.
